Cele kształcenia:

(tylko po angielsku) The course has an introductory, yet comprehensive character. It aims to provide students with basic knowledge on the Convention, its control system and case law of the ECtHR. Having completed the course, the student will be able to apply the Convention to various areas of social life and to read ECtHR’s judgments.

Efekty kształcenia:

(tylko po angielsku) K_W02 has extended, ordered knowledge about the various sub-disciplines of European Studies (law, political science, economics, history, society and culture) in addition to deepened knowledge of his or her chosen sub-discipline.

K_W06 has extended knowledge about international public law, European Union law as well as that of the Council of Europe, including human rights law.

K_U03 has enhanced research skills which include formulating and analyzing research problems, choosing appropriate research methods and techniques, presenting and disseminating the results of research which allows to resolve problems in the field of European Studies.

K_U05 is capable of critical analysis, evaluation and synthesis of new and complex ideas.

K_K07 can apply his or her knowledge and understanding in occupational contexts

I. multiple choice test concerning the material from our lectures (no additional materials are allowed during this part),


II. case analysis concerning a judgment of the ECtHR (during this part you can use all materials you want, including the text of the ECHR, slides, notes etc.). You choose one of the three judgments proposed below.

I strongly suggest you use the Convention and the text of the judgment.

I. Introduction and general information.

Significance of the ECHR. Historical context: origins of the Convention, its preparation, adoption, and coming into force. The ECHR as an international agreement compared with other human rights treaties. Preamble and basic principles of the ECHR. Its structure and additional protocols. Law of the ECHR and its constitutionalisation. Evolution of the ECHR law, Protocol No. 11 and the Interlaken Process.

II. System of the ECHR.

Legal character of the Convention. Accession to the ECHR. Reservations and interpretative declarations. Withdrawal from the ECHR. The ECHR as customary law. Art. 1 ECHR: the notion of jurisdiction. Positive obligations of states. Position of the ECHR in domestic legal orders.

Interpretation of the Convention. The purpose and object of the ECHR. The principle of effective human rights protection. The ECHR as a “living instrument”: dynamic interpretation. Autonomous concepts in ECtHR’s case law. Margin of appreciation. Absolute rights. Limitative clauses.

ECHR control mechanism. Evolution of Strasbourg control mechanisms. Composition and functioning of the ECtHR. Individual applications. Inter-state applications. Conditions of admissibility of applications.

Jurisdiction of the ECtHR. Personal jurisdiction: the scope of states’ responsibility, the notion of a victim. Material jurisdiction. Temporal jurisdiction: the concept of continuous violation. Territorial jurisdiction: extraterritorial application of the ECHR. Derogations of rights and freedoms in special circumstances.

Proceedings before the ECtHR. Role, structure and character of ECtHR’s rulings. Case law databases. Execution of judgments. Advisory opinions.

The ECHR and the European Union. The Convention in Community / EU law. Cooperation between the ECtHR and the CJEU. Indirect responsibility of the EU for violating the ECHR. The accession of the EU to the ECHR.

III. Material content of the ECHR as interpreted by the European Court of Human Rights.

Art. 2, Protocols 6 and 13. Protection of life. Material and procedural obligations of states. Death penalty. Euthanasia and abortion. Use of force by the state. Protection of life and healthcare.

Art. 3. Prohibition of torture, inhuman or degradating treatment or punishment. The notions of torture and inhuman or degradating treatment. Responsibility for prisoners. Deportation and extradition under ECHR protection.

Art. 4. Prohibition of slavery and forced labour. The notions of forced and compulsory labour, acceptable exceptions.

Art. 5. The right to personal freedom and security. Deprivation of liberty, detention, arrest. Legal measures and compensation.

Art. 6, 13. Right to a fair trial. Right to an effective legal remedy. Procedural guarantees, presumption of innocence. Reasonable length of proceedings.

Art. 7. Non-retroactivity in criminal law. Nullum crimen sine lege. Nulla poena sine lege.

Art. 8. Protection of family and private life. The notions of family life and private life. Protection of domicile.

Art. 9. Freedom of thought, conscience and religion. Admissible exceptions, limitative clauses.

Art. 10. Freedom of speech. Rights of journalists. Situation of politicians and public functionaries.
