  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;

Program konwersatorium obejmuje analizę pojęcia nadzoru; nadzór w systemie organów administracji podporządkowanych hierarchicznie – analiza aktualnie obowiązujących regulacji prawnych na wybranych przykładach. Sądowa kontrola działania administracji sprawowana jest bowiem zarówno przez sąd administracyjny jak i inne sądy (sądy powszechne), Trybunał konstytucyjny. Wskazane zostaną związki postępowania administracyjnego i sądowoadministracyjnego w oparciu o założenia teoretyczne i wybrane przepisy prawa pozytywnego; a także zakres kontroli NSA nad działalnością organów administracji. Częścią wykładu będzie również kontrola pozasądowa administracji i w tym zakresie przedstawiony zostanie nadzór administracyjny. Wskazane zostaną normatywne organy nadzoru i pozanormatywne organy sprawujące nadzór. Przedstawiona zostanie procedura postępowania nadzorczego, zakres rozstrzygnięć nadzorczych i ich rodzaje oraz inne formy kontroli.

1 It owns basic knowledge about structure of public administration, structures and functioning of state, institution, as well as other units and it knows and principles of rendering accessible information of administration understand and by it manner of practice public tasks: K_W03 (3)

2. has basic knowledge about legal norms adjusting institution, manner of their appointing understands and competences: K_ W10 (1)

3. it is able to interpret basic legal phenomena correctly and particularly, in range of science about administration with functioning organ of self-governed administration economic related, particularly, in range of practice of public task: : K_U01 (1)

4. it are been able to use basic terminology from range of functioning government administration correctly and self-governed and public tasks execute: K_U05 (2)

Short description:

Program includes analysis of notion of oversight; oversight in system of organ of administration subordinated on chosen examples legal regulation hierarchically. Relationships of administrative procedures will be indicated and chosen regulations positive law. Control of extrajudical administration will be part of lecture also and administrative oversight will be presented in this range.

Full description:

Program includes analysis of notion of oversight system of organ of administration subordinated on chosen examples legal regulation hierarchically – analysis currently obligatory bind. So, judicial control of operation of administration is performed by administrative court equal as well as constitutional tribunal. Relationships of administrative procedures will be indicated and chosen regulations positive law as well as range of control over activity of organ of administration Supreme Administrative Court. Control of extrajudical administration will be part of lecture also and administrative oversight will be presented in this range. Normative organs of oversights will be indicated and extranormative organs performing oversight. Procedure of supervisory procedure will be presented, range supervisory decisions and kind and other forms of controls.
